1 1. Definition of terms
In these terms and conditions, the definitions below have the following meaning where it holds that a definition in singular and plural have an equal meaning unless from the context should be expressly otherwise distracted.
General terms and conditions
These conditions and all additions and adjustments to this.
Registration form
An (electronic) document from MindMastering to confirm the participation in the program.
Client
The person with whom MindMastering enters into an agreement for coaching.
Coach
The supervisor of the service.
Services
Provided by MindMastering are delivered for coaching through online services such as Skype, WhatsApp and telephone.
Agreement
The registration form and the terms and conditions.
Privacy policy
The policy with relating to the processing of personal data.
2 Applicability
2.1
The terms and conditions are applicable to the services deemed to become part of Mind Mastering. MindMastering closes expressly the general terms and conditions out of Client.
2.2
MindMastering adheres at all times the right to change or to add to the terms and conditions and she will give prior notice on the website. If the client does not agree with the change, it has the possibility to use the services without financial consequences.
2.3
If any or more provisions of the general terms and conditions prove to be invalid or be destroyed, then remain the other provisions apply. MindMastering and client will then be into consult with a view to establishing a new provision with regard to the destroyed provision, to be agreed, whereby as much as possible the purpose and scope of the voided provision will be taken.
3 Conclusion of an agreement
3.1
All quotations and offers are made without obligation.
3.2
Client makes a request for a service by filling in the registration form.
3.3
After receipt, Client will receive a request for payment. After the payment has been received by MindMastering, the agreement is deemed to have been concluded and the service is deemed to have commenced in the manner indicated by MindMastering.
3.4
MindMastering is entitled to refuse an application for reasons of its own.
4 Service
4.1
Client and coach enter into a relationship with each other for a certain period of time.
4.2
The treatment relates to the request for help submitted by the client.
4.3
The method of treatment is described on the website under the section “Program”.
4.4
The service is provided for a period of 4 weeks. If circumstances require this for longer, the client and coach will make new agreements about this.
4.5
The agreement ends by operation of law after the end of 4 weeks plus the 3-month aftercare period, calculated from the moment the first day session has taken place.
4.6
45-60 minutes are allotted for daily coaching on working days. It is possible that the 60 minutes are exceeded. No extra costs are charged for this.
4.7
MindMastering is not liable for any adverse consequences that have arisen because the client has supplied incorrect or incomplete information or has not provided available information.
4.8
If the client decides to stop the service, no refund will be given.
4.9
MindMastering is not liable for poor communication connections or shortcomings therein.
4.10
If it is impossible to serve as a result of 4.9. client and coach will choose another time.
5 Billing and Payment
5.1
The compensation is expressed in Euro.
5.2
The fee is exclusive of VAT unless stated otherwise.
5.3
Client will receive the invoice by e-mail prior to the service.
5.4
Payment must be made prior to the service to be provided to an account and/or payment method specified by MindMastering.
5.5
MindMastering reserves the right to introduce price changes on the services. These will be visible on the website.
5.6
Disputes about the invoice must be made known to MindMastering by post or e-mail within 7 days.
6 Privacy Policy
6.1
There is a separate regulation for the privacy policy. You will find this on the website.
7 Liability
7.1
MindMastering is not liable towards the client for any damage arising from the agreement entered into, unless the client proves that the damage was caused by gross negligence or by intent on the part of the service provider.
7.2
Without prejudice to the provisions of paragraph 7.1. MindMastering's liability is limited to direct financial loss of the client and to a maximum of the compensation paid by the client.
7.3
Liability for any indirect damage, loss of profit or other consequential damage is expressly excluded.
7.4
The client must report the shortcoming in writing within 1 month after he has discovered the shortcoming by e-mail info@mindmastering.eu
8 Secrecy
8.1
MindMastering and the client are obliged to maintain confidentiality of all information in the context of the agreement entered into with each other.
It is possible to deviate from this if the client and coach both give permission for this.
9 Disputes and Applicable Law
9.1
In the event of disputes arising directly or indirectly from all agreements to which these general terms and conditions apply, the parties will initially consult each other and seek a solution. If no agreement can be reached, the Court of Antwerp will be the first to take cognizance of this. Belgian law applies.
10 Nullity and destruction
10.1
If part of the General Terms and Conditions is void or voidable, this will not affect the validity of the remaining part of the General Terms and Conditions. Instead of the void or destroyed part, what is legally permissible is the closest thing to what the parties would have agreed upon if they had known the nullity or voidability.
